Additional insureds cannot obtain coverage if the named insured 
does not appear in the action: Nova Casualty Corp. v. Barbieri 


   In this decision, Ken Maguire & Associates, PLLC successfully moved for default judgment on behalf of its client, an insurance company, against its insured, for failing to appear. Although other parties put in opposition, the Court found their positions unavailing. This is of particular importance, because, although third parties who were attempting to obtain coverage under the policy had answered, the named insured's failure to answer the complaint resulted in the Court's decision to void the policy from inception.
